1. QUOTATIONS & ACCEPTANCE
- 1.1 Quotations are valid for 30 days unless otherwise stated.
- 1.2 Acceptance may be given verbally, via email, in writing, or by instruction to commence works.
- 1.3 Prices may be subject to revision if unforeseen conditions, hidden defects, access restrictions, or specification changes occur.
2. SCOPE OF WORKS
- 2.1 Works shall be carried out as described in the Company quotation and/or agreed specification.
- 2.2 Any additional works requested by the Client or required due to unforeseen circumstances will be chargeable.
3. VARIATIONS
- 3.1 Any variations, changes, or additions requested by the Client may affect the final cost and completion date.
- 3.2 Emergency works required for safety or to prevent further damage may be undertaken without prior written approval and charged accordingly.
4. PROGRAMME & TIMESCALES
- 4.1 Any start date or completion date provided is an estimate unless agreed in writing.
- 4.2 The Company shall not be held liable for delays caused by adverse weather, supplier delays, restricted access, third-party contractors, or events beyond its reasonable control.
5. CLIENT RESPONSIBILITIES
- 5.1 The Client must provide safe access to the property/site and working area.
- 5.2 The Client must disclose any known hazards including asbestos, fragile roof areas, restricted zones, and concealed services.
6. BUILDING REGULATIONS & COMPLIANCE
- 6.1 Works will be completed to a professional standard and, where applicable, in accordance with UK Building Regulations, British Standards, and manufacturer guidelines.
- 6.2 Where Building Control approval is required, this remains the responsibility of the Client unless agreed otherwise in writing.
7. PAYMENT TERMS
- 7.1 A payment schedule will be agreed in writing before commencing work.
- 7.2 Payment shall be made in accordance with the agreed schedule and invoice terms.
- 7.3 Final payment is due upon satisfactory completion of the Works or within 14 days of the final invoice date, whichever is sooner.
- 7.4 The Company reserves the right to withhold guarantees, certificates, warranties, or completion documentation until full payment has been received.
8. LATE PAYMENT
- 8.1 Failure to pay within agreed terms may result in suspension of works.
- 8.2 Interest and recovery costs may be charged in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 (where applicable).
9. MATERIALS & OWNERSHIP
- 9.1 All materials supplied remain the property of Tess Contractors Ltd until paid for in full.
10. DEFECTS & GUARANTEES
- 10.1 Any workmanship guarantee will only apply if stated in writing.
- 10.2 Guarantees do not cover storm damage, vandalism, lack of maintenance, blocked gutters, structural movement, or third-party interference.
- 10.3 The Company must be given reasonable opportunity to inspect and rectify any issues before the Client instructs a third party.
11. INSURANCE
- 11.1 The Company holds relevant insurance including Public Liability Insurance.
- 11.2 Insurance documentation can be provided upon request.
12. LIMITATION OF LIABILITY
- 12.1 The Company shall not be liable for indirect or consequential losses (including loss of profit or business interruption).
- 12.2 Liability is limited to the total value of the Works invoiced under the relevant contract/job.
- 12.3 Nothing in these terms excludes liability for death or personal injury caused by negligence or any matter that cannot legally be excluded under UK law.
13. CANCELLATION
- 13.1 If the Client cancels after acceptance, the Company may charge for labour completed, materials ordered, hire costs, and reasonable administrative or scheduling losses.
14. CONTRACT (UPON REQUEST)
- 14.1 A formal written contract will be drawn up upon request by the Client.
15. GOVERNING LAW
- 15.1 These Terms & Conditions are governed by the laws of England and Wales, and any disputes shall be dealt with exclusively by the courts of England and Wales.
